NCP enables the design of a complete power train, load – gearbox – motor. Based on an input of load data, the system will calculate the selected gearbox. With its "Look-and-Feel" design, the straightforward, intuitive user interface, an extended training is not necessary. In addition, the user is provided with a variety of customizable load curves. With more than 6,000 motor data records available, users may choose between virtually all currently available motors.

IMPORTANT- PLEASE READ CAREFULLY: This agreement is a valid contract between you and Neugart GmbH (Neugart) for the attached and above mentioned Software "Neugart Calculation Program - NCP", the computer software and possibly attached data bases, printed materials and documentation in "Online" - or electronical version contained ("Software").
BY INSTALLING THIS SOFTWARE, YOU AGREE TO BE BOUND BY THE FOLLOWING PROVISIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE, YOU ARE NOT ALLOWED TO INSTALL THIS SOFTWARE.
1. LICENCING. Neugart grants you the rights settled in this agreement provided that you comply with all provisions of this licence agreement.
1.1 INSTALLATION AND USE. You are allowed to install the software on a single computer in your business premises as e.g. on a working station, a terminal or on any other device. You are only allowed to make one safety copy of this software. It is strictly forbidden to make any further copies.
On installation, Neugart grants the license holder a non-exclusive, time-limited right to use the software in accordance with the conditions of this contract. The contract period for the software is 1 year, to ensure that the program is up-to-date. The license holder is strongly recommended to update the program regularly. On the expiry of the contract period, the license holder must completely delete the licensed material as well as all copies and partial copies made of it, including modified or edited versions, unless Neugart extends the license.
The license holder is responsible for installing the software. The installation instructions should be followed exactly. Compliance with the necessary system requirements is solely the license holder's responsibility.
The client must obtain and install at his or her own expense and in a timely manner any additional software necessary for the software (e.g. system software in the version provided, database software etc.) in the appropriate release version.
1.2 RESERVATION OF RIGHTS AND PROPERTY. Neugart reserves all rights in the software which are not explicitly granted in this agreement. The Software is protected by copyright laws and by other laws and agreements concerning intellectual property rights. The Software will be licensed, not be sold.
1.3 NO SUPPORT. Neugart does not guarantee any support in respect of the Software.
2. ADDITIONAL SOFTWARE. This enduser licence agreement is also valid for updates or additions of the software except that with the update or the addition other provisions shall be applicable.
3. TRANSFER OF THE SOFTWARE.
3.1 INTERNAL TRANSFER. You are allowed to transfer the software to another computer within your business premises.
3.2 NO LEASE. You are not allowed to rent or sell, nor to lease or lend out the software.
4. RESTRICTION IN RESPECT OF REVERSE ENGINEERING; DECOMPILING AND DISASSEMBLING. You are not permitted to copy the software, either wholly or in part, or to modify, to combine with other software, to decompile, to produce software products based on this software or its components, to rent, license or use the software in another form or to reproduce other than as expressly permitted by these conditions.
5. TERMINATION. Irrespective of other rights Neugart is entitled to terminate this licence agreement if you infringe any of the provisions of this agreement. In such a case you are obliged to destroy any copies of the software.
6. EXPORT RESTRICTIONS. You acknowledge that the Software is governed by the Export Law of the Federal Republic of Germany. You agree to comply with all applicable international and national laws, which are valid for the Software (especially AWG, AWV, Dual-Use-VO, KWKG), including the regulations of the United States of America concerning the Export Control (US Export Administration Regulations) and all restrictions in respect of endusers.
7. LIMITATION OF LIABILITY. For damages or compensation of useless expenses including tort the following provisions shall be applicable. Neugart shall be liable according to the law of product liability. As for the rest Neugart places the software for free at your disposal. Neugart points out that it is –according to the state of the art- not possible, to install software which is able to operate in all possible combinations without any faults. Any liability for claims is explicitly excluded (except the liability according to the product liability law), especially damages for loss of profit, breakdown, loss of business or other information, loss of data or other financial loss. All data/information and particulars given in this software is non-binding customer information, subject to constant further development and continuously updated by our permanent alteration service. Please note that all particulars/figures/information is current data at the date of printing. These particulars are not legally binding for the purpose of measurement, calculation or cost accounting. Prior to using any of the information contained in this software as a basis for your own calculations and/or applications, please inform yourself about whether the information you have at your disposal is up to date. Therefore, no liability is assumed for the correctness of the information.
8. VIRUSES. Neugart does not warrant that the software and the potential data carrier are free from computer viruses. It is your responsibility to check for the presence of any such computer viruses with the aid of suitable tools and it is strongly recommended that you do so. Neugart accepts no responsibility whatsoever for direct or indirect damage of any kind caused by the presence of computer viruses.
9. APPLICABLE LAW. The law of the Federal Republic of Germany shall be applicable to all rights and duties arising out of this licence agreement. The United Nations Convention On Contracts For The International Sale Of Goods shall not apply to this contract. Place of jurisdiction and of performance for all rights and duties of this agreement and disputes in respect of the enforcement of this agreement shall be the seat of the headquarter of Neugart.
10. MISCELLANEOUS. This licence agreement (and all supplements and additional agreements to this agreement, which are contained in the scope of delivery of the software) shall be the whole agreement and understanding between Neugart and you in respect of the software. This licence agreement shall have priority over all previous or concurrently oral or written messages or proposals in respect of the software. In case that any provision of this licence agreement is held invalid or unenforceable, the remaining provisions shall be still valid.
11. NON-INCORPORATION CLAUSE. The conditions of this contract apply. Any business terms of the client do not form part of the contract.
In case of doubts concerning the interpretation and translation of this agreement the German version shall be the basis of this agreement.
